部分失業(yè)保險(xiǎn)條例參考

　　第二十一條 單位招用的農(nóng)民合同制工人連續(xù)工作滿１年，本單位并已繳納失業(yè)保險(xiǎn)費(fèi)，勞動合同期滿未續(xù)訂或者提前解除勞動合同的，由社會保險(xiǎn)經(jīng)辦機(jī)構(gòu)根據(jù)其工作時(shí)間長短，對其支付一次性生活補(bǔ)助。

　　Article 21 If a contract-system farmer worker engaged by a unit has been working continuously for not less than one year, and the unit has paid unemployment insurance premium, where no contract is renewed when the employment contract is expired or the contract is terminated in advance, the social insurance agency shall pay one-off living subsidy to the farmer worker according to the length of his working period.

　　補(bǔ)助的辦法和標(biāo)準(zhǔn)由省、自治區(qū)、直轄市人民政府規(guī)定。

　　Measures and standards for such subsidy are to be stipulated by people's governments of provinces, autonomous regions and municipalities directly under the Central Government.

　　第二十二條 城鎮(zhèn)企業(yè)事業(yè)單位成建制跨統(tǒng)籌地區(qū)轉(zhuǎn)移，失業(yè)人員跨統(tǒng)籌地區(qū)流動的，失業(yè)保險(xiǎn)關(guān)系隨之轉(zhuǎn)遷。

　　Article 22 If enterprises and institutions in cities and towns move as a whole from one area where overall planning is conducted to another one, or if the unemployed moves among area where overall planning is conducted, the social insurance credentials are to be moved together.

　　第二十三條 失業(yè)人員符合城市居民最低生活保障條件的，按照規(guī)定享受城市居民最低生活保障待遇。

　　Article 23If the unemployed are qualified for minimal living ensuring standard for urban residents, they are entitled to enjoy the benefit of the minimal living ensuring standard for urban residents.

　　第四章 管理和監(jiān)督

　　Chapter Four Administration and Supervision

　　第二十四條 勞動保障行政部門管理失業(yè)保險(xiǎn)工作，履行下列職責(zé)：

　　Article 24 In the administration of social insurance, the administrative department of labor security shall perform the following duties:

　�。ㄒ唬┴瀼貙�(shí)施失業(yè)保險(xiǎn)法律、法規(guī)；

　　a.implement and enforce laws and regulations on unemployment insurance;

　�。ǘ�）指導(dǎo)社會保險(xiǎn)經(jīng)辦機(jī)構(gòu)的工作；

　　b.guide the work of social insurance agencies;

　　（三）對失業(yè)保險(xiǎn)費(fèi)的征收和失業(yè)保險(xiǎn)待遇的支付進(jìn)行監(jiān)督檢查。

　　c.conduct supervision and inspection on collection of unemployment insurance premium and payment of unemployment insurance compensation.

　　第二十五條 社會保險(xiǎn)經(jīng)辦機(jī)構(gòu)具體承辦失業(yè)保險(xiǎn)工作，履行下列職責(zé)：

　　Article 25 When undertaking concretely the work of social insurance, social insurance agencies shall perform the following duties:

　�。ㄒ唬┴�(fù)責(zé)失業(yè)人員的登記、調(diào)查、統(tǒng)計(jì)；

　　a.being responsible for registration, investigation and statistics of the unemployed;

　�。ǘ�）按照規(guī)定負(fù)責(zé)失業(yè)保險(xiǎn)基金的管理；

　　b.being responsible for administration of unemployment insurance funds according to provisions;

　�。ㄈ�）按照規(guī)定核定失業(yè)保險(xiǎn)待遇，開具失業(yè)人員在指定銀行領(lǐng)取失業(yè)保險(xiǎn)金和其他補(bǔ)助金的單證；

　　c.checking and determining unemployment insurance benefits, and issuing documents for the unemployed by which they receive unemployment insurance compensation and or other subsidies from designated banks;

　�。ㄋ模�撥付失業(yè)人員職業(yè)培訓(xùn)、職業(yè)介紹補(bǔ)貼費(fèi)用；

　　d.appropriating subsidiary fees for vocational training and job seeking for the unemployed;

　�。ㄎ澹�為失業(yè)人員提供免費(fèi)咨詢服務(wù)；

　　e.offering free consultation service to the unemployed;

　�。�六）國家規(guī)定由其履行的其他職責(zé)。

　　f.other duties stipulated by the State to perform.

　　第二十六條 財(cái)政部門和審計(jì)部門依法對失業(yè)保險(xiǎn)基金的收支、管理情況進(jìn)行監(jiān)督。

　　Article 26 Financial departments and auditing departments shall supervise the collection, payment and administration of unemployment insurance funds according to law.

　　第二十七條 社會保險(xiǎn)經(jīng)辦機(jī)構(gòu)所需經(jīng)費(fèi)列入預(yù)算，由財(cái)政撥付。

　　Article 27 Outlays for social insurance agencies shall be listed into budget and appropriated from government finance.

　　第五章 罰則

　　Chapter Five Penalty Provisions

　　第二十八條 不符合享受失業(yè)保險(xiǎn)待遇條件，騙取失業(yè)保險(xiǎn)金和其他失業(yè)保險(xiǎn)待遇的，由社會保險(xiǎn)經(jīng)辦機(jī)構(gòu)責(zé)令退還；

　　Article 28 Where anyone disqualified for enjoying unemployment insurance benefits defrauds unemployment insurance compensation and other unemployment insurance benefits, the social insurance agency shall order them to be returned,

　　情節(jié)嚴(yán)重的，由勞動保障行政部門處騙取金額１倍以上３倍以下的'罰款。

　　where the circumstances are serious, a fine of not less than one time but not more than three times the amount defrauded shall be imposed by administrative department of labor security.

　　第二十九條 社會保險(xiǎn)經(jīng)辦機(jī)構(gòu)工作人員違反規(guī)定向失業(yè)人員開具領(lǐng)取失業(yè)保險(xiǎn)金或者享受其他失業(yè)保險(xiǎn)待遇單證，致使失業(yè)保險(xiǎn)基金損失的，由勞動保障行政部門責(zé)令追回；情節(jié)嚴(yán)重的，依法給予行政處分。

　　Article 29Where a functionary of a social insurance agency, in violation of provisions, issues documents for receiving unemployment insurance compensation or enjoying other unemployment insurance benefits for the unemployed, thus causing losses of unemployment insurance funds, the administrative department of labor security shall order them to be recovered; where the circumstances are serious, administrative sanctions shall be imposed according to law.

　　第三十條 勞動保障行政部門和社會保險(xiǎn)經(jīng)辦機(jī)構(gòu)的工作人員濫用職權(quán)、徇私舞弊、玩忽職守，造成失業(yè)保險(xiǎn)基金損失的，由勞動保障行政部門追回?fù)p失的失業(yè)保險(xiǎn)基金；

　　Article 30Where a functionary of the administrative department of labor security and the social insurance agency abuses his power, neglects his duties and practice favoritism, thus resulting in the losses of unemployment insurance funds, the administrative department of labor security shall recover the lost unemployment insurance funds;

　　構(gòu)成犯罪的，依法追究刑事責(zé)任；尚不構(gòu)成犯罪的，依法給予行政處分。

　　if the violations constitute crimes, criminal liability shall be investigated according to law; if no crime is constituted, administrative sanctions shall be imposed according to law.

　　第三十一條 任何單位、個(gè)人挪用失業(yè)保險(xiǎn)基金的，追回挪用的失業(yè)保險(xiǎn)基金；

　　Article 31 If any unit or individual misappropriates unemployment insurance funds, the misappropriated fund shall be recovered;

　　有違法所得的，沒收違法所得，并入失業(yè)保險(xiǎn)基金；

　　if there is illegal income, such illegal income shall be confiscated and merged into unemployment insurance funds;

　　構(gòu)成犯罪的，依法追究刑事責(zé)任；尚不構(gòu)成犯罪的，對直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員依法給予行政處分。

　　if the violations constitute crimes, criminal liability shall be investigated according to law; if no crime is constituted, administrative sanctions shall be imposed according to law upon the persons in charge who bear direct responsibility and other persons directly responsible.

　　第六章 附則

　　Chapter Six Supplementary Provisions

　　第三十二條 省、自治區(qū)、直轄市人民政府根據(jù)當(dāng)?shù)貙?shí)際情況，可以決定本條例適用于本行政區(qū)域內(nèi)的社會團(tuán)體及其專職人員、民辦非企業(yè)單位及其職工、有雇工的城鎮(zhèn)個(gè)體工商戶及其雇工。

　　Article 32 The people's governments of provinces, autonomous regions and municipalities directly under the Central Government, according to the actual local situations, may determine whether these Regulations apply to social organizations and their full-time staff, private non-enterprise units and their staff and workers, or individual industrial and commercial businesses in cities and towns with employees that are located within their respective administrative areas.

　　第三十三條 本條例自發(fā)布之日起施行。１９９３年４月１２日國務(wù)院發(fā)布的《國有企業(yè)職工待業(yè)保險(xiǎn)規(guī)定》同時(shí)廢止。

　　Article 33These Regulations take effect as of the date of promulgation. The Provisions on Unemployment Insurance of Staff and Workers in State-owned Enterprises, promulgated by the State Council on April 12th 1993, is annulled simultaneously.
