Regulations on Unemployment Insurance
第一章 總則
Chapter One General Provisions
第一條 為了保障失業(yè)人員失業(yè)期間的基本生活，促進(jìn)其再就業(yè)，制定本條例。
Article 1These Regulation are formulated to guarantee basic livings of the unemployed during the unemployment period and promote their reemployment.
第二條 城鎮(zhèn)企業(yè)事業(yè)單位、城鎮(zhèn)企業(yè)事業(yè)單位職工依照本條例的規(guī)定，繳納失業(yè)保險(xiǎn)費(fèi)。
Article 2Enterprises and institutions in cities and towns as well as their staff and workers shall pay unemployment insurance premium in accordance with these Regulations.
城鎮(zhèn)企業(yè)事業(yè)單位失業(yè)人員依照本條例的規(guī)定，享受失業(yè)保險(xiǎn)待遇。
The unemployed of enterprises and institutions in cities and towns may enjoy the benefits of unemployment insurance in accordance with these Regulation .
本條所稱城鎮(zhèn)企業(yè)，是指國有企業(yè)、城鎮(zhèn)集體企業(yè)、外商投資企業(yè)、城鎮(zhèn)私營企業(yè)以及其他城鎮(zhèn)企業(yè)。
Enterprises and institutions in cities and towns mentioned in this Article refer to State-owned enterprises, collectively owned enterprise in cities and towns, enterprise with foreign investment, privately owned enterprise in cities and towns as well as other enterprise in cities and towns
第三條 國務(wù)院勞動(dòng)保障行政部門主管全國的失業(yè)保險(xiǎn)工作。
Article 3The administrative department of labor security under the State Council is in charge of unemployment insurance work throughout the country.
縣級(jí)以上地方各級(jí)人民政府勞動(dòng)保障行政部門主管本行政區(qū)域內(nèi)的失業(yè)保險(xiǎn)工作。
The administrative departments of labor security under the people's governments at or above the county level are in charge of unemployment insurance work within their respective administrative areas.
勞動(dòng)保障行政部門按照國務(wù)院規(guī)定設(shè)立的經(jīng)辦失業(yè)保險(xiǎn)業(yè)務(wù)的社會(huì)保險(xiǎn)經(jīng)辦機(jī)構(gòu)依照本條例的規(guī)定，具體承辦失業(yè)保險(xiǎn)工作。
Social insurance agencies engaging in unemployment insurance business established by administrative departments of labor security in accordance with provisions of the State Council will undertake concretely the unemployment insurance work.
第四條 失業(yè)保險(xiǎn)費(fèi)按照國家有關(guān)規(guī)定征繳。
Article 4Unemployment insurance premium is collected and paid according to relevant provisions of the State.
第二章 失業(yè)保險(xiǎn)基金
Chapter Two Unemployment Insurance Funds
第五條 失業(yè)保險(xiǎn)基金由下列各項(xiàng)構(gòu)成：
Article 5Unemployment insurance funds include the following items:
�。ㄒ唬┏擎�(zhèn)企業(yè)事業(yè)單位、城鎮(zhèn)企業(yè)事業(yè)單位職工繳納的失業(yè)保險(xiǎn)費(fèi)；
a.unemployment insurance premium paid by enterprises and institutions in cities and towns as well as their staff and workers;
（二）失業(yè)保險(xiǎn)基金的利息；
b.interest of unemployment insurance fund;
（三）財(cái)政補(bǔ)貼；
c.financial subsidies;
（四）依法納入失業(yè)保障基金的其他資金。
d.other funds incorporated into unemployment insurance funds according to law.
第六條 城鎮(zhèn)企業(yè)事業(yè)單位按照本單位工資總額的百分之二繳納失業(yè)保險(xiǎn)費(fèi)。
Article 6Enterprises and institutions in cities and towns shall pay unemployment insurance premium at a rate of 2% on the basis of their total amount of salaries.
城鎮(zhèn)企業(yè)事業(yè)單位職工按照本人工資的百分之一繳納失業(yè)保險(xiǎn)費(fèi)。
Staff and workers in enterprises and institutions in cities and towns shall pay unemployment insurance premium at a rate of 1% on the basis of their own salaries.
城鎮(zhèn)企業(yè)事業(yè)單位招用的農(nóng)民合同制工人本人不繳納失業(yè)保險(xiǎn)費(fèi)。
Contract-system farmer workers engaged by enterprises and institutions in cities and towns do not pay unemployment insurance premium themselves.
第七條 失業(yè)保險(xiǎn)基金在直轄市和設(shè)區(qū)的市實(shí)行全市統(tǒng)籌；其他地區(qū)的統(tǒng)籌層次由省、自治區(qū)人民政府規(guī)定。
Article 7 Overall planning for unemployment insurance funds is to be conducted in municipalities directly under the Central Government and cities divided into districts; levels of overall planning in other areas are to be stipulated by people's governments of provinces and autonomous regions.
第八條 省、自治區(qū)可以建立失業(yè)保險(xiǎn)調(diào)劑金。
Article 8 Provinces and autonomous regions may establish adjustment funds of unemployment insurance.
失業(yè)保險(xiǎn)調(diào)劑金以統(tǒng)籌地區(qū)依法應(yīng)當(dāng)征收的失業(yè)保險(xiǎn)費(fèi)為基數(shù)，按照省、自治區(qū)人民政府規(guī)定的比例籌集。
Adjustment funds of unemployment insurance are to be raised at a ratio prescribed by people's governments of provinces or autonomous regions, taking unemployment insurance premium that should be collected according to law in areas where overall planning is conducted as the base.
統(tǒng)籌地區(qū)的失業(yè)保險(xiǎn)基金不敷使用時(shí)，由失業(yè)保險(xiǎn)調(diào)劑金調(diào)劑、地方財(cái)政補(bǔ)貼。
If unemployment funds in areas where overall planning is conducted are not enough for use, adjustment funds of unemployment insurance may be used as adjustment and local finance may be used as subsidies.
失業(yè)保險(xiǎn)調(diào)劑金的籌集、調(diào)劑使用以及地方財(cái)政補(bǔ)貼的具體辦法，由省、自治區(qū)人民政府規(guī)定。
Specific measures for raising and adjusting adjustment funds of unemployment insurance and for local financial subsidies are to be stipulated by people's governments of provinces and autonomous regions.
第九條 省、自治區(qū)、直轄市人民政府根據(jù)本行政區(qū)域失業(yè)人員數(shù)量和失業(yè)保險(xiǎn)基金數(shù)額，報(bào)經(jīng)國務(wù)院批準(zhǔn)，可以適當(dāng)調(diào)整本行政區(qū)域失業(yè)保險(xiǎn)費(fèi)的費(fèi)率。
Article 9 People's governments of provinces, autonomous regions and municipalities directly under the Central Government, according to the number of the unemployed and the amount of unemployment insurance funds for their respective administrative areas, and after the approval by the State Council, may adjust properly rate of unemployment insurance premium.
第十條 失業(yè)保險(xiǎn)基金用于下列支出：
Article 10 Unemployment insurance funs shall be used for the following expenditure:
（一）失業(yè)保險(xiǎn)金；
a.unemployment insurance compensation;
�。ǘ╊I(lǐng)取失業(yè)保險(xiǎn)金期間的醫(yī)療補(bǔ)助金；
b.medical subvention during the period of receiving unemployment insurance compensation;
�。ㄈ╊I(lǐng)取失業(yè)保險(xiǎn)金期間死亡的失業(yè)人員的喪葬補(bǔ)助金和其供養(yǎng)的配偶、直系親屬的撫恤金；
c.funeral allowance for the unemployed died during the period of receiving unemployment insurance compensation and pension for spouse and direct relatives supported by the dead person;
（四）領(lǐng)取失業(yè)保險(xiǎn)金期間接受職業(yè)培訓(xùn)、職業(yè)介紹的補(bǔ)貼，補(bǔ)貼的辦法和標(biāo)準(zhǔn)由省、自治區(qū)、直轄市人民政府規(guī)定；
d.subsidy for accepting job training and job seeking during the period of receiving unemployment insurance compensation. Measures and Schemes for such subsidy are to be stipulated by people's governments of provinces, autonomous regions and municipalities directly under the Central Government;
（五）國務(wù)院規(guī)定或者批準(zhǔn)的與失業(yè)保險(xiǎn)有關(guān)的其他費(fèi)用。
e.other expenses relating to unemployment insurance stipulated or approved by the State Council.
