法案中針對(duì)外籍人才引進(jìn)及留用的新政具體為以下幾點(diǎn):
1. Increases the H-1B cap from 65,000 to 115,000 and allows the cap to go up (but not above 195,000) or down (but not below 115,000), depending on actual market demand.
H-1B配額數(shù)量將由之前的6萬(wàn)5千人增長(zhǎng)到11萬(wàn)5千人。并且根據(jù)每年人才市場(chǎng)的需求量,配額可最多增長(zhǎng)至19萬(wàn)5千人,最低配額為11萬(wàn)5千人。
2. Exempts dependents of employment-based immigrant visa recipients, U.S. STEM advanced degree holders, persons with extraordinary ability, and outstanding professors and researchers from the employment-based green card cap.
就業(yè)移民簽證持有者的家屬,STEM專業(yè)高等學(xué)位持有者,特殊技能持有者,杰出教授或科研人員獲得綠卡申請(qǐng)名額豁免。
3. Authorizes employment for dependent spouses of H-1B visa holders.
授權(quán)H-1B持有者的配偶在美國(guó)就業(yè)。
4. Removes the existing 20,000 cap on the U.S. advanced degree exemption for H-1Bs.
取消現(xiàn)有的每年2萬(wàn)美國(guó)高等學(xué)歷的豁免名額制度。從此該名額無(wú)2萬(wàn)限制。
5. Eliminates annual per-country limits for employment-based visa petitioners and adjusts per-country caps for family-based immigrant visas.
取消每年各區(qū)域的工簽申請(qǐng)限制,并調(diào)整各區(qū)域以家庭為基礎(chǔ)的移民簽證配額。
