◆ Tips for Labor Law – Overtime Salary
Overtime salary shall be calculated on the basis of standardized salary per working day or hour, in which the daily salary shall be determined by a monthly salary divided by 21.75,and salary per hour shall be determined by a daily salary divided by 8.
The way to determine overtime salary shall be different in different days. If the overtime happened in ordinary working days, the overtime salary shall be 1.5 times of standardized salary; in weekend without taking deferred holidays, it shall be 2 times; in public holidays shall be 3 times. However, those employees enjoyed non-fixed working hours, which has been approved by the Department of Human Resources and Social Security, shall not be paid overtime salaries, except otherwise stipulated in other local regulations.
◆ 勞動(dòng)法小常識(shí)——加班工資
加班工資基數(shù)為勞動(dòng)者標(biāo)準(zhǔn)工作日或小時(shí)工資,日工資以月薪除以21.75 進(jìn)行計(jì)算,小時(shí)工資以日工資除以8 進(jìn)行計(jì)算。
根據(jù)加班日的不同,用人單位應(yīng)當(dāng)支付的工資倍數(shù)也不同:在標(biāo)準(zhǔn)工作日為1.5倍;在休息日又不能補(bǔ)休的為2倍;在法定休假日為3倍。經(jīng)勞動(dòng)保障部門批準(zhǔn)實(shí)行不定時(shí)工作制的,一般無須向勞動(dòng)者支付加班工資,但各地有特殊政策的除外。
