結(jié)果加重犯的內(nèi)在關(guān)系及法定刑配置之思考
摘 要
我國(guó)刑法學(xué)界對(duì)結(jié)果加重犯這種犯罪形態(tài)的研究尚存在著認(rèn)識(shí)上的分歧，尤其是對(duì)結(jié)果加重犯的組成結(jié)構(gòu)存在許多不同的見(jiàn)解。集中了學(xué)界中的幾種主要的學(xué)說(shuō)，運(yùn)用辯證唯物的方法對(duì)現(xiàn)今爭(zhēng)議較大“因交通肇事逃逸致人死亡”的案例加以分析，得出結(jié)果加重犯實(shí)際應(yīng)存在3種結(jié)構(gòu)形式。依此對(duì)結(jié)果加重犯的法定刑進(jìn)行合理的配置。研究結(jié)果加重犯的內(nèi)在關(guān)系及其法定刑配置問(wèn)題有助于統(tǒng)1結(jié)果加重犯的概念，同時(shí)也有利于確定行為人的行為性質(zhì)。

Abstract
There are many points of The aggregated consequential offences in our country criminal law academic circles , especially about the constitution of aggregated consequential offences. Author find the real constitution of aggregated consequential offences by analyze a precedent which named “ death in the traffic accident cause by the troublemaker run away ” and then make the Legal punishment equitable on the basis of the real constitution . Study the intrinsic relationship of the aggravation offenders and the reasonable configuration for the offenders is helpful to unity the concept of the aggravation offenders. at the same time it is helpful to indentify the assence of the prepetrator.
