論我國執(zhí)行救濟制度的完善

摘 要

執(zhí)行瑕疵導致執(zhí)行過程中出現(xiàn)執(zhí)行難、執(zhí)行亂的現(xiàn)象，也正是這么1些痼疾的存在，使得當事人或第3人需要尋求1種足以保護其受損權(quán)利的機制，“沒有救濟就沒有權(quán)利”。因此，執(zhí)行救濟應(yīng)運而生。本文指出我國現(xiàn)行法中規(guī)定執(zhí)行救濟制度存在的嚴重缺陷，明確公正與效率、分權(quán)與制衡是確立我國執(zhí)行救濟制度的基本原則，并在此基礎(chǔ)上，從程序和實體兩方面對我國的執(zhí)行執(zhí)行救濟制度進行完善。

Abstract

The defects of execution cause the phenomenon that the executions are hard to carry out, and the parties or the third party’s right a lot of harm. “No succor, no right .” So, the system of the succor execution occurs. The thesis points out serious defects in the provisions of system of succor execution in current law and makes it clear that the basic principles to the establishment of the system is clean-cut justice and effectiveness as well as decentralization and check and balance. On this foundation, the thesis
designs a system of succor execution on both procedure and entity in China.
