正當(dāng)防衛(wèi)法律價值的理性思考

[摘要] 正當(dāng)防衛(wèi)制度經(jīng)歷了久遠(yuǎn)的沿革，完成了從個人本位到本位的嬗變。在法治社會的今天，為了促進(jìn)人類文明的進(jìn)步，正當(dāng)防衛(wèi)制度內(nèi)含相互協(xié)調(diào)的多元的價值追求。但我國的正當(dāng)防衛(wèi)制度在整體構(gòu)建上卻存在法律價值缺失的，值得關(guān)注。
